อำนาจหน้าที่เทศบาล
อํานาจหน้าที่ตามพระราชบัญญัติเทศบาล พ.ศ. 2496 และที่แก้ไขเพิ่มเติมถึง (ฉบับที่ 14) พ.ศ. 2562
1. อํานาจหน้าที่ตามมาตรา 50 ได้กําหนดอํานาจหน้าที่ที่เทศบาลตําบลต้องทํา ได้แก่
(1) รักษาความสงบเรียบร้อยของประชาชน
(2) ให้มีและบำรุงทางบกและทางน้ำ
(3) รักษาความสะอาดของถนน หรือทางเดินและที่สาธารณะ รวมทั้งการ กําจัดมูลฝอยและสิ่งปฏิกูล
(4) ป้องกันและระงับโรคติดต่อ
(5) ให้มีเครื่องใช้ในการดับเพลิง
(6) จัดการ ส่งเสริมและสนับสนุนการจัดการศึกษา ศาสนา และการฝึกอบรมให้แก่ประชาชน รวมทั้งการจัดการหรือสนับสนุนการดูแลและพัฒนาเด็กเล็ก
(7) ส่งเสริมการพัฒนาสตรี เด็ก เยาวชน ผู้สูงอายุ และผู้พิการ
(8) บำรุงศิลปะ จารีตประเพณี ภูมิปัญญาท้องถิ่น และวัฒนธรรมอันดีของท้องถิ่น
(9) หน้าที่อื่นตามที่กฎหมายบัญญัติให้เป็นหน้าที่ของเทศบาล
2. อํานาจหน้าที่ตามมาตรา 53 ได้กําหนดอํานาจหน้าที่ที่เทศบาลเมืองต้องทํา ได้แก่
(1) กิจกรรมที่ระบุไว้ในมาตราที่ 50
(2) ให้มีน้ำสะอาดหรือการประปา
(3) ให้มีโรงฆ่าสัตว์
(4) ให้มีและบำรุงสถานีที่ทำการพิทักษ์และรักษาคนเจ็บไข้
(5) ให้มีและบำรุงทางระบายน้ำ
(6) ให้มีและบำรุงส้มสาธารณะ
(7) ให้มีและบำรุงการไฟฟ้า หรือแสงสว่างโดยวิธีอื่น
(8) ให้มีการดำเนินกิจการโรงรับจำนำหรือสถานสินเชื่อท้องถิ่น
(9) จัดระเบียบการจารจร หรือ ร่วมมือกับหน่วยงานอื่นในการปฎิบัติหน้าที่ดังกล่าว
ภารกิจ อำนาจหน้าที่ของเทศบาลเมืองสองพี่น้อง
๑ ด้านโครงสร้างพื้นฐาน มีภารกิจที่เกี่ยวข้อง ดังนี้
๑.๑ การจัดให้มีและบำรุงรักษาทางบกทางน้ำ และทางระบายายน้ำ (มาตรา ๑๖ (๒) ) และพระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒ มาตรา ๕๐ (๒)มาตรา ๕๑ (๘) แห่งพระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๑.๒ การสาธารณูปโภคและการก่อสร้างอื่นๆ มาตรา ๑๖ (๔)
๑.๓ การสาธารณูปการ มาตรา ๑๖ (๕) พระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒
๑.๔ การควบคุมอาคาร มาตรา ๑๖ (๒๘) พระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒
๑.๕ จัดให้มีน้ำสะอาดและการประปา มาตรา ๕๓ (๒) แห่งพระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๑.๖ จัดให้มีและบำรุงการไฟฟ้า หรือแสงสว่างโดยวิธีอื่น มาตรา ๕๓ (๗) แห่งพระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๒ ด้านส่งเสริมคุณภาพชีวิต มีการกิจที่เกี่ยวข้อง ดังนี้
๒.๑ การจัดการศึกษา มาตรา ๑๖ (๕) พระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒
๒.๒ การส่งเสริมกีฬา มาตรา ๑๖ (๒๘) พระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒
๒.๓ การสาธารณสุข การอนามัยครอบครัว และการรักษาพยาบาล มาตรา
๑๖ (๑๙) พระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒
๒.๔ ป้องกันและระงับโรคติดต่อ มาตรา ๕๐ (๔) แห่งพระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๒.๕ ส่งเสริมการพัฒนาสตรี เด็ก เยาวชน ผู้สูงอายุและผู้ผู้พิการ มาตรา ๕๐ (๓) แห่งพระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๒.๖ การรักษาความสะอาดของถนนหรือทางเดิน และที่สาธารณะ รวมทั้งการกำจัดขยะมูลฝอยสิ่งปฏิกูลและน้ำเสีย มาตรา ๕๐ (๓) แห่งพระราชบัญญัติเทศบาล พ.ศ.๒๔๙๙๙๖๖
๒.๗ ให้มีและบำรุงสวนสาธารณะ สวนสัตว์ และสถานที่พักผ่อนหย่อนใจ มาตรา ๕๔(๑๐) แห่งพระราชบัญญัติเทศบาล พ.ศ.ศ.๒๔๙๖
๒.๘ บำรุงและส่งเสริมการประกอบอาชีพของราษฎร มาตรา ๕๔ (๓) แห่งพระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๒.๙ การสังคมสงเคราะห์ และการพัฒนาคุณภาพชีวิตเด็ก สตรี คนขราและผู้ด้อยโอกาส มาตรา ๑๖ (๑๐)
๓ ด้านการจัดระเบียบชุมชน สังคม และการรักษาความสงบเรียบร้อย มีภารกิจที่เกี่ยวข้อง ดังนี้
๓.๑ การส่งเสริมประชาธิปไตย ความเสมอภาค และสิทธิเสรีภาพของประชาชน
๓.๒ การป้องกันและบรรเทาสาธารณภัย
๓.๓ การรักษาความสงบเรียบร้อยของประชาชน มาตรา ๕๐ (๑) พระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๔ ด้านการวางแผน การส่งเสริมการลงทุน พาณิชยกรรมและการท่องเที่ยว มีภารกิจที่เกี่ยวข้อง ดังนี้
๔.๑ บำรุงและส่งเสริมการทำมาหากินของราษฎร มาตรา ๕๑ (๕) พระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๔.๒ การจัดทำแผนพัฒนาเทศบาล การอนุญาตให้จัดตั้งโรงงาน การบำรุงรักษาแหล่งท่องเที่ยว การส่งเสริมการท่องเที่ยว การส่งเสริมอาชีพ และการลงทุนในระดับชุมชน
๕ ด้านการบริหารจัดการและการอนุรักษ์ทรัพยากรรรมชาติและสิ่งแวดล้อม มีภารกิจที่เกี่ยวข้อง ดังนี้
๕.๑ การจัดการ การบำรุงรักษาและการใช้ประโยชน์จากป่าไม้ ที่ดิน ทรัพยากรธรรมชาติและสิ่งแวดล้อม มาตรา ๑๖ (๒๔) พระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.ศ.๒๕๒
๕.๒ ลดปริมาณขยะ นำของที่ใช้แล้วมาหมุนเวียนและนำขยะเข้าสู่ขบวนการผลิตใหม่
๕.๓ การบำบัดน้ำเสียในเขตเทศบาล
๕.๔ การติดตามตรวจสอบคุณภาพสิ่งแวดล้อมในเขตเทศบาล
๕.๕ ปรับปรุงแหล่งเสื่อมโทรม และรักษาควาแสะอาดเรียบร้อยของถิ่น มาตรา ๕๑ (๑๑) แห่งพระราชบัญญัติเทศบาล พ.ศ.๒๔๙๖
๕.๖ รักษาความสะอาดถนนและทางเดิน และที่สาธารณะ รวมทั้งกำจัดขยะมูลฝอยและสิ่งปฏิกูล มาตรา ๕๐ (๓) แห่งพระรารบัญญัติเทศบาล พ.ศ.๒๔๘๘๙๖
๖ ด้านการศาสนา ศิลปวัฒนธรรม จารีตประเพณี และภูมิปัญญาท้องถิ่น มีภารกิจที่เกี่ยวข้อง ดังนี้
๖.๑ การบำรุงรักษาโบราณสถาน บำรุงรักษาศิลปะ จารีตประเพณี ภูมิปัญญาท้องถิ่นและวัฒนธรรมอันดีของท้องถิ่น มาตรา ๕๐ (๘) พระราชบัญญัติเทศบาล พ.ศ.ศ.๒๔๙๖ มาตรา ๑๖ (๑๑) พระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒
๗ ด้านการบริหารจัดการและการสนับสนุนการปฏิบัติภารกิจของส่วนราชการและองค์กรปกครองส่วนท้องถิ่น มีภารกิจที่เกี่ยวข้อง ดังนี้
๗.๑ สนับสนุนองค์กรปกครองส่วนท้องถิ่นอื่น ในการพัฒนาท้องถิ่น
๗.๒ ร่วมเป็นคณะกรรมการบริหารจัดการด้านสิ่งแวดล้อมอื่นๆ ด้านการบริหารจัดการลุ่มน้ำ ปัญหาภัยแล้ง เป็นต้น
ภารกิจทั้ง ๗ ด้าน เป็นอำนาจหน้าที่ตามกฎหมายที่เทศบาลต้องดำเนินการ เพื่อแก้ไขปัญหาและตอบสนองความต้องการของประชาชนในท้องถิ่นถิ่นได้อย่างสมบูรณ์ มีประสิทธิภาพและสัมฤทธิ์ผลตรงตามความต้องการของประชาชนในท้องถิ่นอย่างแท้จริง โดยสอดคล้องกับพระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒ แผนพัฒนาเศรษฐกิจและสังคมแห่งชาติ ฉบับที่ ๑๒ (พ.ศ.๒๕๖๐-๒๕๖๔) และนโยบายของผู้บริหาร
